It is designed to confirm that no suitably qualified or experienced Australian worker is available to fill the role.

For employers, this means advertising the position in appropriate channels for a set period, meeting strict evidence requirements, and demonstrating that the recruitment process has been conducted in line with legislative obligations. This includes providing copies of job ads, details of where and when they were placed, the responses received, and clear justification for the decision to nominate an international candidate.

What evidence do I need?

For all 482 and 494 nominations, employers must provide evidence that the role was advertised through at least two national recruitment channels. These advertisements must be accessible to a national audience and may be placed on platforms such as:

  • Seek
  • Indeed
  • Jora
  • Glassdoor
  • LinkedIn

 

Alternatively, employers can meet the requirement by advertising on their accredited sponsor website, in print media, or via radio.

Until recently, a third mandatory advertisement on Workforce Australia was required. This obligation has now been removed, simplifying the Labour Market Testing process while still maintaining the expectation of genuine, well-documented recruitment efforts. LMT Exemptions

In some circumstances, Labour Market Testing is not required. Australia has committed to various international trade agreements that waive the requirement under specific conditions. These exemptions generally apply when a business or nominated worker meets certain nationality, organisational, or senior-management criteria.

LMT may not be required when:

• The nominated worker is applying under an LMT-exempt category within an international trade agreement and is a citizen or national of Brunei, China, Japan, Malaysia, Mexico, Peru, Thailand, or a citizen, national, or permanent resident of Canada, Chile, South Korea, New Zealand, Singapore, or the United Kingdom.

• The nominated worker is currently employed by an associated entity of the sponsoring business, and that associated entity operates in an ASEAN country, Canada, Chile, China, Japan, Mexico, South Korea, the United Kingdom, New Zealand, Peru, Samoa, Tuvalu, Kiribati, Tonga, Solomon Islands, Niue, the Cook Islands, or Vanuatu.

• The nominated worker is an executive or senior manager employed by an associated entity located in a World Trade Organisation member country, and the role will involve responsibility for all, or a substantial part, of the company’s Australian operations.

• The sponsoring business operates in a WTO member country or in Tuvalu, Kiribati, Niue, or the Cook Islands, and is seeking to establish an Australian presence. The nomination must be for an executive or senior management role within the meaning of relevant international trade obligations.

• The nominated worker is a citizen or eligible permanent resident of a WTO member country and has already worked in the nominated position in Australia, full-time, for the past two years.

 

These exemptions exist to honour Australia’s international trade commitments. For all other situations, Labour Market Testing remains a core requirement, designed to ensure Australian citizens and permanent residents are given genuine access to available roles before overseas workers are considered.
