Employment obligations for Tasmanian employers : Hiring in Tasmania? See the state rules on long service leave, payroll tax, workers compensation and regional public holidays, and what stays federal.
Key takeaways
- Long service leave is 8 2/3 weeks after 10 years, under a Tasmanian Act, not the NES.
- Payroll tax starts once Australian wages pass $1.25 million: 4%, then 6.1% above $2 million.
- Every employer needs a workers compensation policy. Tell your insurer about injuries within 3 working days.
- Regatta Day, Recreation Day and show days depend on where each employee is based for work.
- Minimum wages, super, awards and the NES are federal and work the same as on the mainland.
Most employment obligations for Tasmanian employers match the mainland. The ones that don’t cause the most trouble. Take a Hobart retailer that opens a second store in Launceston and copies its payroll calendar across. In February the Launceston team gets paid for Royal Hobart Regatta, which isn’t a holiday in the north. In November nobody spots Recreation Day. Two pay runs, two errors, one awkward backpay conversation.
The differences sit in four places: long service leave, payroll tax, workers compensation and public holidays. This guide covers each one, with every figure checked against Tasmanian government sources in September 2026.
Employment obligations for Tasmanian employers: federal vs state
Almost every private sector employer in Tasmania, sole traders included, sits in the national Fair Work system. From the first full pay period on or after 1 July 2026, the national minimum wage is $26.44 an hour. Modern award rates rose 4.75%, according to the Fair Work Ombudsman. Super guarantee is 12%, and under Payday Super it must reach the employee’s fund within 7 business days of each payday.
The National Employment Standards and unfair dismissal rules are federal too. Tasmania controls a shorter list, and that’s where the state-specific mistakes happen.
Set federally vs set by Tasmania
Federal: same in every state
Minimum wages and awards - $26.44 an hour minimum from 1 July 2026. Award rates rose 4.75%.
Super guarantee - 12% of qualifying earnings, received by the fund within 7 business days of payday.
NES leave and dismissal rules - Annual, personal, parental and family violence leave, plus unfair dismissal and redundancy.
Tasmanian: state law
Long service leave - Long Service Leave Act 1976. 8 2/3 weeks after 10 years.
Payroll tax - Payroll Tax Act 2008. $1.25 million threshold, collected by the SRO.
Workers compensation - Private licensed insurers, regulated by WorkSafe Tasmania.
Public holidays - Statutory Holidays Act 2000, including regional Regatta and show days.
Long service leave under the Tasmanian Act
For most employees, long service leave isn’t in the NES. In Tasmania it comes from the Long Service Leave Act 1976, administered by WorkSafe Tasmania.
- After 10 years’ continuous employment: 8 2/3 weeks of paid leave.
- Every further 5 years: another 4 1/3 weeks.
- WorkSafe’s formula: years of continuous employment divided by 10, multiplied by 8.667 weeks.
Casuals trip up payroll most. A casual or part-time employee counts as continuously employed if they regularly work 32 hours or more in each consecutive four-week period. Track hours in four-week blocks.
Pro rata payment between 7 and 10 years isn’t automatic. It applies in set circumstances, such as the employer ending employment for a reason other than serious misconduct, or the employee resigning through illness. WorkSafe’s example: 9 years of service gives 9 x 0.8667, or about 7.8 weeks.
Two sectors run differently. Construction employers register workers with TasBuild and pay into a portable scheme under the Construction Industry (Long Service) Act 1997. Mining employees have their own rules. If you also employ interstate, don’t let payroll software copy another state’s settings across.
Payroll tax in Tasmania: when you become liable
Payroll tax is an employer cost under the Payroll Tax Act 2008, collected by the State Revenue Office. If you pay wages in Tasmania, you’re liable once your total Australian wages pass $1.25 million a year. The weekly equivalent is $24,038 in any month (SRO registration rules). Grouped businesses share one threshold.
That catches mainland firms. A Melbourne company with a $2 million national payroll and three Hobart staff may owe Tasmanian payroll tax on those wages, less a share of the threshold.
Rates for 2026-27, per the SRO rates table:
- Wages up to $1.25 million: 0%
- Wages from $1,250,001 to $2 million: 4%
- Wages above $2 million: 6.1%
So a Launceston manufacturer with $1.6 million in Tasmanian wages and no interstate staff pays 4% on the $350,000 above the threshold: $14,000 for the year. Returns go through Tasmanian Revenue Online monthly, with an annual adjustment return. Wages paid during maternity or adoption leave are exempt for up to 14 weeks. Paternity leave pay isn’t.

Working days to tell your insurer about an injury likely to cause time off

WorkSafe Tasmania and workers compensation
Tasmania has no government-run insurer. Under the Workers Rehabilitation and Compensation Act 1988, every employer must hold a policy with a licensed insurer or a self-insurance permit. That includes a business with one casual.
The timeframes are tight. WorkSafe’s guide to the Act sets them out:
- Tell your insurer within 3 working days of learning about an injury likely to cause time off.
- Give the worker written notice of their right to claim within 14 days.
- When a claim arrives, notify your insurer within 3 working days and forward it within 5.
- Start weekly payments and cover medical costs up to $5,000, even if you dispute the claim.
- Dispute liability within 84 days, or you’re taken to have accepted it.
You must also keep an injured worker’s job open for 12 months and offer suitable alternative duties where practicable.
Time off is getting longer. WorkSafe’s 2023 statewide snapshot recorded 8,177 injuries, and 51% led to at least a week off work, up from 38% ten years earlier. Weekly payments run at 100% of normal earnings for the first 26 weeks.

Tasmanian public holidays and regional show days
Tasmania’s holidays come from the Statutory Holidays Act 2000, and several apply only in parts of the state. What counts is where each employee is based for work, not your head office. The 2026 dates that matter most:
- Royal Hobart Regatta, Monday 9 February: southern Tasmania, including Hobart.
- Eight Hours Day, Monday 9 March: statewide.
- Easter Tuesday, 7 April: generally Tasmanian Public Service only, unless an award or agreement says otherwise.
- Royal Hobart Show, Thursday 22 October: parts of the south, including Hobart.
- Recreation Day, Monday 2 November: every area that doesn’t observe Regatta. Staff get one or the other, never both.
- Boxing Day, Monday 28 December: Tasmania doesn’t hold it on Saturday 26 December this year.
Easter Saturday and Easter Sunday aren’t on Tasmania’s statewide list, unlike NSW and Victoria (Fair Work 2026 list). October also brings the Royal Launceston Show and other north and north-west show days, each gazetted for set areas. Check WorkSafe’s regional table before you lock those pay runs.
Penalty rates for working a public holiday come from the award, which is where a wrong region costs money.
Is there any other state-based leave?
Not much for private employers. Annual, personal, carer’s, compassionate, parental and family and domestic violence leave all come from the NES. Tasmania adds long service leave, the construction portable scheme and its holiday list.
Getting the Tasmanian settings right
Small businesses with fewer than 20 employees make up 97% of Tasmanian businesses, according to Business Tasmania. So these settings often sit with an owner or a bookkeeper. Most errors are setup errors: a file tagged to the wrong region, or a threshold nobody rechecks after a hiring run.

Frequently Asked Questions (FAQs)
Does long service leave in Tasmania apply to casual employees?
Yes. Casual and part-time employees are covered by the Long Service Leave Act 1976 once they reach 10 years of continuous employment. They count as continuously employed if they regularly work 32 hours or more in each consecutive four-week period. A pro rata payment can apply after 7 years if employment ends in certain circumstances. Keep hours records in four-week blocks.
When does a business have to register for payroll tax in Tasmania?
You must register if you pay wages in Tasmania and your total Australian wages exceed $1.25 million a year, or $24,038 a week during a month. Grouped businesses count together. Registration and monthly returns go through Tasmanian Revenue Online. For 2026-27 the rate is 4% on wages between $1.25 million and $2 million, and 6.1% on wages above $2 million.
Is Recreation Day a public holiday in Hobart?
No. Recreation Day, on the first Monday in November, applies only in areas that don't observe the Royal Hobart Regatta. Hobart takes Regatta in February instead. In 2026, Regatta fell on Monday 9 February and Recreation Day falls on Monday 2 November. Launceston and the north take Recreation Day.
Do I need workers compensation insurance for one part-time employee?
Yes. Tasmania's workers compensation law requires every employer to hold a policy with a licensed insurer, or a permit to self-insure. Headcount doesn't matter. Full-time, part-time and casual employees are covered, and some contractors can be too. If you're uninsured and a worker is hurt, the Nominal Insurer can pay the claim and then try to recover the cost from you.
Is Easter Tuesday a public holiday for private sector staff in Tasmania?
Generally not. WorkSafe Tasmania lists Easter Tuesday, 7 April in 2026, as generally applying to the Tasmanian Public Service only. Private sector employees get it only where their award or enterprise agreement includes it. Check the instrument covering each employee before the Easter pay run.
